Abercrombie & Fitch ‘Show Us Your Style’ Contest Terms and Conditions (“Contest Terms”)

NO PURCHASE NECESSARY TO PARTICIPATE. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING.

ELIGIBILITY: The Abercrombie & Fitch (“A&F”) ‘Show Us Your Style’ Contest (“Contest”) is open only to legal residents of the United States and the District of Columbia, who are at least fourteen (14) years old at the time of entry. Void where prohibited. The Contest is subject to all applicable federal, state, and local laws and regulations. Participation in the Contest constitutes entrant’s full and unconditional agreement to these Official Rules and Sponsor’s decisions, which are final and binding in all matters related to the Contest. Winning a prize is contingent upon fulfilling all requirements set forth herein.

TIMING: Entry period is open from March 7, 2014 at 8:00 am Eastern Time (“ET”) until March 21, 2014 at 11:59 pm ET. Sponsor’s computer is the official time-keeping device for the Contest.

HOW TO PARTICIPATE: You must have an Instagram account to participate; it is free to create one. During the open dates of the Contest, post on Instagram your own original pictures (in any format) showing A&F Style and tag @Abercrombie and #AFStyle (“Entry”). You may submit as many Entries as you like during the Contest. If you are a potential winner, after the close of the Contest you will receive a direct message back to the same Instagram account you used to enter with instructions on how to verify your win.

WINNER SELECTION AND NOTIFICATION: After each day of the Contest, Sponsor will select from among all eligible entries received during the entire Contest, one (1) Entry which best aligns with displaying A&F style as determined by Sponsor in its sole discretion, for a total of fifteen (15) winners over the entire Contest period. Entries will be judged by members of A&F’s Brand Marketing team using the following criteria: (a) overall composition quality of the photo; (b) ability to portray A&F style; (c) originality of outfitting (creative use of product and styling).

Sponsor reserves the right (but is not obligated) to increase both the number of winners and prizes awarded at any time. Potential Contest winners will be notified via direct message on Instagram with a request to verify their win within one (1) day of their selection. Potential winners will be required to respond to Sponsor within three (3) days of when the initial notification was sent, and will be required to confirm several pieces of information to verify their win. Potential winners must confirm their name (first/last), city of residence, that they are 14 years of age or older, and that they agree to these Contest Terms. If a potential winner does not respond to the comment within three (3) days of when the initial notification comment was made, or refuses to confirm the requested information, then the potential winner will be disqualified and forfeits their right to the prize and an alternate winner may be selected. Prizes will be sent to winners after their win is verified.

PRIZES: Each winner will receive one (1) A&F E-Gift Card for $250.00 (ARV $250.00). There will be fifteen (15) total winners selected. The E-Gift Card will be delivered directly to the winner via either direct message on Instagram or via E-Mail if necessary. A&F E-Gift Cards are redeemable for merchandise only in the US or Canada either online or in stores. E-Gift Card cannot be redeemed for cash unless required by applicable law. It cannot be replaced if lost or stolen. Purchases in a currency different from the currency of the card will be subject to an exchange rate conversion on the day of payment. GENERAL RULES OF PARTICIPATION: This Contest is subject to all applicable federal, state and local laws, and is void where prohibited or restricted by law. By participating in this Contest, the Participant agrees: (a) to abide by and be bound by these Contest Terms and decisions of Sponsor which shall be final in all respects relating to the Contest, including without limitation the interpretation of these Contest Terms; (b) the laws of the United States and the State of Ohio apply to and govern this Contest and any claims must be raised and resolved in the federal or state courts located in Columbus, OH, United States; (c) if, for any reason whatsoever, this Contest, in Sponsor's sole opinion, is not capable of running as planned, including, but not limited to, to comply with legal requirements or by reason of infection by computer virus, tampering, fraud, technical failures, or any other cause which, in the Sponsor's sole judgment, corrupts or affects the administration, security, fairness, integrity or proper conduct of this Contest, Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend this Contest and limit entries to those submitted prior to the action taken, or to proceed in such a manner as may be deemed fair and equitable by Sponsor in its sole discretion; (d) if such cancellation, termination, modification or suspension occurs, notification will be posted on Instagram where the Contest is listed; (e) Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the operation of the Contest, or to be acting in violation of the terms of this or any other Contest; (f) any attempt by any person to deliberately damage any website or undermine the legitimate operation of the Contest is a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law; (g) in the event of a dispute as to any entry, the authorized account holder of the social media account used to enter will be deemed to be the participant. The "authorized account holder" of a social media account, is the natural person who registered for the profile. The potential winner may be required to show proof of being the authorized account holder, including but not limited to the proof issued by the social media platform; (h) winners are responsible for all federal, state, and local taxes and fees which may be associated with prize receipt and/or use; (i) Sponsor's failure to enforce any term of these Contest Terms shall not constitute a waiver of that provision; (j) For a winner list, visit www.Abercrombie.com/anf/media/legalText/A&FContestsWinnersList.html. The winner list will be posted after all winner confirmations are complete.

NO LIABILITY/RELEASE: By participating, the Participant agrees to release, discharge, indemnify and hold harmless the Sponsor against any claims made by participants, or any other third parties, related in any way to the operation of this Contest as well as any other claims, damages or liability due to any injuries, damages or losses to any person (including death) or property of any kind resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any surprise, participation in any Contest-related activity, or participation in this Contest in general. While it involves interaction with social media platforms, this Contest is in no way endorsed, administered by, or associated with any social media platform. You understand that you are providing your information to Sponsor and not to social media platforms. Any questions, comments, or complaints regarding this Contest should be addressed to Sponsor and not to social media platforms. Any information collected by participating in this Contest shall be used only in a manner consistent with these Contest Terms and with Sponsor’s privacy policy.

GRANT OF RIGHTS: By entering, and except where prohibited by law, you (or your parent/guardian if you are under the age of majority in your jurisdiction) grant to Sponsor (and any of its agents, affiliates or subsidiaries) the irrevocable, non-exclusive, worldwide, royalty-free, sub-licensable, assignable, and unlimited right and permission, but not the obligation, to (1) utilize, reproduce, exploit, alter, edit, modify, distribute, publish, exhibit, digitize, broadcast, display, publicly perform, and prepare derivative works of the Entry in any form or media now or hereafter known for any and all purposes deemed by Sponsor in its sole discretion to be reasonable and prudent uses for the purpose of furthering its valid business objectives, including but not limited to reposting the Entry online (e.g., on our brand websites and social media pages) and (2) use your name, online handle, and profile/avatar picture in connection with, or to reference the fact of, your Entry. You understand that your Entry may be edited in the sole discretion of Sponsor. You represent and warrant that the Entry will not contain any third party trademarked or copyrighted material, or material that is subject to other third party proprietary rights, unless you have permission from the rightful owner of such material or you are otherwise legally entitled to post the material and to grant Sponsor all relevant licenses and permissions to use the material as contemplated herein. You agree not to take any legal action against, and release and discharge, Sponsor, and its directors, officers, employees, agents and affiliates, or any other person or entity acting on its behalf, from all claims in connection with the use of the Entry as contemplated herein.
